H-4 to F-1 Change of Status

H-4 dependents (spouses and children of H-1B holders) can generally already study full-time without changing status — H-4 to F-1 becomes relevant mainly for CPT/OPT work authorization, or when a dependent child turns 21 and "ages out" of H-4 eligibility.

Overview

H-4 status (held by the spouse or unmarried children under 21 of an H-1B holder) already generally permits full-time study without needing to change status. H-4 to F-1 becomes a relevant, deliberate choice mainly in two situations: wanting F-1-specific work authorization (CPT/OPT), or a dependent child approaching age 21, who must transition to a different status to remain in the US lawfully as they "age out" of H-4 dependent eligibility.

Who Should Consider This Pathway

H-4 dependents who want CPT/OPT work authorization tied to their studies, or H-4 dependent children nearing 21 who need a lawful status to remain in the US.

Eligibility

Apply to and be accepted by an SEVP-certified school, obtain an initial Form I-20, pay the SEVIS I-901 fee, and file Form I-539 with USCIS while still in valid H-4 status.

Advantages

Access to F-1-specific benefits (CPT during study, OPT/STEM OPT after), and — for aging-out dependent children — a lawful path to remain in the US.

Limitations

If you leave the US while your change of status application is pending, USCIS generally considers the application abandoned. Timing matters closely for dependent children approaching 21 — file with enough buffer before the birthday.

Important Considerations

If your only goal is to study (not to work via CPT/OPT), changing from H-4 to F-1 may not be necessary at all — confirm with your DSO or an immigration professional whether remaining on H-4 meets your needs before filing.

Timeline

Processing timelines vary. Specific fees, processing times, and procedural details change over time — always confirm current requirements directly with USCIS, Study in the States, SEVP, or your school's international student office before acting.

Required Documentation

Form I-539, initial Form I-20, evidence of current H-4 status, and proof of financial support.
